These Terms & Conditions (the “T&C” or “Terms”) govern the registration, issuance, and use of the Concession for access to the private road known as [Road Name] (“Road”) owned, operated, and maintained by Lingkaran Cekap Sdn. Bhd. (the “Company” or “LCSB”). By registering for a Concession, the Resident (defined in Item 2.2 below) agrees to be bound by these T&C.

  1. Acceptance of Terms
    By entering, driving on, or otherwise using the Road, the Resident acknowledges that they have read, understood, and agreed to be bound by the T&C, including any updates that may be published from time to time.
  2. Eligibility
    2.1 A Resident is an individual owning a property within [Genting Highlands area] (“Area”) for own use, an individual who lives in the Area on a long-term basis, or a company whose primary place of business is physically located within the Area.
    2.2 Only Residents are eligible to apply for a Concession.
    2.3 Each residential property within the Area is entitled to register to a maximum of [number] Concession(s) unless otherwise approved by LCSB.
    2.4 Residential Residents can only apply for Concessions for vehicles classified as Class 1.
    2.5 Companies may apply for Concessions for vehicles in Classes 1, 2 or 3.
  3. Application and Registration
    3.1 Residents must submit accurate information, proof of ownership or residence, and any other supporting documents requested by LCSB. The proof of ownership and residence required to be submitted are:• the Sale & Purchase Agreement, Rental Agreement or similar agreements, AND
    • the latest electricity bill.3.2 Each Concession allows one (1) vehicle to be registered. As verification, the following documents will be required:
    • Picture(s) of the vehicle clearly showing the front and back of the vehicle with its license plate clearly legible, and clearly identifying the make and model of the vehicle.
    3.3 LCSB may require additional documents for verification.
    3.4 LCSB reserves the right to approve or reject any application at its sole discretion.
    3.5 Providing false, misleading, or incomplete information may result in rejection or revocation of the Concession.
  4. Concession Issuance and Validity
    4.1 The Concession is non-transferable. Only the registered vehicle may use the Concession.
    4.2 Use of the Concession does not confer ownership, tenancy, or any other legal rights over the Road.
    4.3 The Concession is valid for the period specified upon issuance of the Concession or communicated thereafter. Residents who wish to continue use the Concession, and are still eligible, may apply for renewal.
  5. Responsibility of Residents
    5.1 Residents must comply with all rules, regulations, and instructions issued by the LCSB or relevant road management.
    5.2 Residents are responsible for ensuring that all drivers using their Concession comply with road safety regulations.
    5.3 Any damage to property, vehicles, or infrastructure on the Road caused by the Resident or their guests may be subject to liability and recovery by LCSB or the road management.
  6. Prohibited Use and Restrictions
    The Resident SHALL NOT:
    a) Use the vehicle for commercial purposes, including but not limited to delivery services, ride-sharing services, or business operations.
    b) Unauthorized use or sharing of the Concession may result in immediate revocation.
  7. Vehicle Requirements
    7.1 All vehicles using the Concession must be properly registered, insured, and roadworthy in accordance with applicable laws.
    7.2 Vehicle(s) must display valid registration plates at all times.
    7.3 The Resident must re-register any new vehicles, even if the new vehicle has the same license plate number.
    7.4 Oversized vehicles, heavy goods vehicles, or vehicles exceeding weight limits specified by LCSB are prohibited unless prior written approval is obtained.
  8. Liability & Indemnity
    8.1 The Resident understand and acknowledge that the access and uses of the Road are entirely at their own risk.8.2 LCSB, its shareholders, subsidiaries, associated or related parties, including their personnel, shall not be liable to the Resident or any other person for:• Any loss, injury, damage, or death• Any damage to Resident’s vehicle(s) or any other vehicle(s)
    • Any loss of property, theft, or vandalism resulting from the use of the Road or being unable to use the Road. This applies even if we are negligent or in breach of this Agreement.
    8.3 The Resident agrees to indemnify and hold harmless the Company, its shareholders, subsidiaries, associated or related parties, including their personnel, from any claims, losses, liabilities, damages, or expenses resulting from the use or misuse of the Concession.
  9. Suspension and Revocation
    9.1 The Company may revoke or suspend the Concession without prior notice due to any of, but not limited to, the following reasons:
    • Violation of these T&C,
    • Misuse, transfer, or unauthorized use of the Concession,
    • Providing false or fraudulent information during registration,
    • Violation of the Terms and Conditions for the use of the Road,
    • Damage(s) to LCSB’s, or any of its related companies’, property or infrastructure, or
    • Harassment, abuse, threats to LCSB’s, or any of its related companies’, personnel or to other Road users.
    9.2 The Company is not obligated to provide reasons for suspension or revocation.
    9.3 No refund of fees paid will be provided for suspended or revoked Concessions.
  10. Fees, Concessions & Payments
    10.1 The Concession may be subject to fees as determined by the Company from time to time.
    • Violation of these T&C,
    • Misuse, transfer, or unauthorized use of the Concession,
    • Providing false or fraudulent information during registration,
    • Violation of the Terms and Conditions for the use of the Road,
    • Damage(s) to LCSB’s, or any of its related companies’, property or infrastructure, or
    • Harassment, abuse, threats to LCSB’s, or any of its related companies’, personnel or to other Road users.
    10.2 All fees must be paid in full prior to the issuance or renewal of the Concession.
    10.3 Fees paid are non-refundable except as required by law.
    10.4 The Company reserves the right to change, modify or update the fees by providing a 30 days’ notice to Residents/Concession Holders.
    10.5 Payment of Concession does not automatically grant the right to use the Road.
  11. Privacy
    11.1 Personal information collected during registration will be used solely for the issuance and tracking of Concessions issued.
    11.2 By applying to the Concession, you consent to the Company collecting, processing, and storing your data. The Company may collect data such as, but not limited to, the following:
    • Personal information
    • Vehicle details (plate number, type, registration information) Any information collected will be handled according to the applicable laws.
    11.3 Personal information collected during registration will be used solely for the issuance and tracking of Concessions issued.
  12. Changes to Terms & Conditions
    12.1 The Company reserves the right to amend these T&C at any time.
    12.2 The prevailing T&C will be displayed on LCSB’s website. Nevertheless, the continued use of the Concession constitutes acceptance of the prevailing T&C.
